For more than fifteen(15) years the AICJQ has been offering bi-annual continuing legal education seminars, but since the beginning of the Covid-19 pandemic, the Association needed to accommodate its members and focused its efforts on webinars in order to continue to offer its members and the legal community, webinars recognized by the Barreau du Québec for the obligatory training required for continuing legal education.

22nd Seminar - Amendements to the « la loi sur les normes du travail »

In Quebec, the rights and obligations of workers and employers are contained in the Act respecting labor standards. The labour standards objectives are to protect employees by imposing minimum acceptable working conditions. Recently, the National Assembly adopted significant changes to this Act. The purpose of this conference is to provide an overview of the law with a discussion on the modifications brought about by the recent legislative amendment to the Act. Mtre. Aristeo will expose the comparative study between the prior rights &obligations of workers and employers and the modifications of their rights & obligations.

22nd Seminar - Immigration and the refugee protection system in Canada, Part II

This conference given by Mtre Gabriele Spina, who is legal adviser to the federal government, at the Ministry of Immigration, Refugees and Citizenship, presents the second part of a presentation given previously concerning asylum applications before the Refugee Board and the interventions of the Minister of Immigration, Refugees and Citizenship. The presenter analyzes the relevant laws&applicable regulations, examines the case law, the burden of proof requirements as well as the various criteria and exclusions provided for in the law ®ulations of immigration.

22nd Seminar - Social programs offered at the Montreal Municipal Court

The purpose of this conference is to expose the various social programs at the Municipal Court of the City of Montreal. Mtre. Johnson provides an overview of the following programs: POINT FINAL - the program which aims to help defendants in cases of impaired driving, CONCILIATION - the program which targets cases that involve acquaintances (co-workers, friends, neighbors), PAJTO - the drug addiction justice support program, EVE - the program aimed to help females accused of economic crime cases (theft, fraud, shoplifting), CÔTÉ COUR - the program which aims to assist victims of domestic violence, PAJSM - the mental health justice support program, and PAJMA - the elder abuse justice support program.

22nd Seminar - Prosecutorial Discretion: The Crown’s Right to Repudiate a Plea Agreement

An exhaustive study of the R v. Couche-Tard Inc decision in Superior Court and before the Court of Appeal of Quebec. In this judgement, the prosecution brings (2) two charges against Alimentation Couche-Tard Inc. It accuses the defendants of having conspired to prevent or reduce competition in the retail sale of gasoline, contrary to article 45 (1) c of the Competition Act. The prosecutor and the defense lawyer establish an agreement but after signing the agreement, it is repudiated by the said prosecutors' superior and the same charges are brought against a related entity. The latter files a motion for stay of proceedings. The Court of Appeal rules on the parties arguments concerning the agreement negotiated between the prosecutor and the defense and the decision of the Director of Prosecution to repudiate the agreement reached between the parties. Mtre. Paci exposes the arguments from both parties on the legal points being debated in the courts on this eminently important issue.
